Terms and conditions

OBJECT

1. GSX Portugal Unip. Lda. (“GLOBALSPORT”), with registered offices at Rua D. Manuel Vieira de Matos, nº 70, 5050-345 Poiares, with share capital of €5,000, registered at the Sintra Commercial Registry Office, with the registration and legal person identification number 514 779 012, as an organization of tourist entertainment activities, other unspecified sports activities, organization of fairs and other similar events, offers its clients (“Clients”) the possibility of purchasing services and products associated with the services it provides.

2. These Terms and Conditions (“Terms and Conditions”) regulate access to and use of all GLOBALSPORT-owned websites through which GLOBALSPORT Customers can consult information about the products and services offered by GLOBALSPORT (“Products and Services”) and place their order (“Order”) and purchase them electronically.

3. The Products and Services purchased will be delivered in Portugal, or abroad according to the countries provided on the purchase form.

3.1. The digital Products and Services will be delivered to the e-mail address indicated by the Customer.

4. All the Products and Services available in the Online Shop are in accordance with and comply with the requirements of Portuguese law.

5. The elements and information transmitted by the Customer at the time of the Order shall have full legal effect, and the Customer may not allege the absence of a signature for breach of the obligations assumed.

6. The Order and the purchase of the Products and Services presuppose the reading, knowledge and acceptance of the provisions of these Terms and Conditions.

7. GLOBALSPORT reserves the right to change or revise these Terms and Conditions at any time, and any changes will be posted on www.globalsport.pt .

INFORMATION ON PRODUCTS AND SERVICES

1. The Products and Services have the characteristics indicated in their description in the Online Shop, the use made by the Customer after purchasing the Products and Services is the sole responsibility of the Customer.

2. GLOBALSPORT cannot guarantee, at all times, the accuracy and correctness of the information provided in the Online Shop about the Products and Services, but undertakes to correct any errors as soon as they are detected.

3. If, for reasons not attributable to GLOBALSPORT, such as human or computer errors, it is not possible to guarantee the delivery of all the Products and Services ordered, GLOBALSPORT undertakes to inform the Customer of this fact and the Customer will have the right to cancel the Order placed and the amount already paid will be refunded.

4. GLOBALSPORT reserves the right not to complete an Order if there are errors in the values or characteristics of the Products and Services due to technical problems beyond its control, informing the Customer accordingly.

5. GLOBALSPORT reserves the right to change the marketing conditions of the Products and Services presented in the Online Shop at any time, namely the price, characteristics and services.

6. All prices quoted include VAT at the legal rate in force.

7. Transaction fees may be applied by the online payment service providers used by the Online Shop. In the case of the registration platform, transaction fees for payments via Multibanco references are automated and the service provider that charges the lowest fee on the total value of the purchase of Products and Services by Customers is selected.

8. The offer presented in the Online Shop is limited to existing stock.

ORDER REQUEST

1. The data indicated at the time of the Order request as having to be provided is essential for the Order to be placed. The omission or inaccuracy of such data is the sole responsibility of the Customer and may result in the Order not being placed.

2. The Customer assumes full and exclusive responsibility for the authenticity, accuracy, veracity and timeliness of the data provided at the time of the Order. If any of the data provided proves to be incorrect or insufficient, GLOBALSPORT reserves the right to prohibit future purchases and block access to the Online Shop.

3. To order a Product or Service, the Customer must select the “Add to Cart” option next to the description of the desired Product or Service.

4. The Customer may, up to the time of dispatch of the Product and Service, check or modify their Order, and may also change the number of Products and Services desired or exclude Products and Services from their Order.

5. After choosing the Products and Services, the Customer will have to confirm the Order and, for this purpose, enter the requested data and choose the payment method they prefer. Once all the elements have been validated by the Customer, the Order will be completed and the Customer will receive an email with the information relating to the Order.

ORDER DELIVERY

Delivery to the address indicated by the Customer: The delivery address will be indicated by the Customer during the purchase process – “delivery address”. Orders for delivery to PO boxes in Portugal and other countries are not accepted. The Order will be dispatched according to GLOBALSPORT’s logistical availability, except in the event of a stock outage. Delivery will be made by courier, to the address indicated by the Customer, on working days between 9 a.m. and 6 p.m. in Portugal, in other countries at the time set by the couriers in the country in question. If the Customer is not at the delivery address indicated by them, they must follow the information that the courier can leave in the mailbox. If this is not possible, the order will be returned to GLOBALSPORT and canceled – GLOBALSPORT will be charged for the costs associated with this process.

Delivery to the e-mail address indicated or used by the Customer: Delivery will be sent to the email address entered by the Customer on the purchase or registration form. The insertion, validity and veracity of the Customer’s email address will always be the Customer’s responsibility. According to the settings, the email sent may be redirected to your SPAM folder.

ORDER PAYMENT

The Customer has the following payment methods available:

a) Multibanco: the Order can be paid for by multibanco, at an ATM or via homebanking. At the time of purchase, the Customer is informed of the Entity / Reference / Amount and has 3 (three) consecutive days to make the payment. At the end of this period, and if the Order has not been paid for, GLOBALSPORT will cancel it. Acceptance of the Order will begin once it has been paid for – VALID ONLY IN PORTUGAL.

b)Paypal: payment by Paypal is a secure method which uses your credit card details. For more information on this payment method, visit www.paypal.com .

ORDER CANCELLATION

1. The Order may not be canceled at the Customer’s request once payment has been made by the Customer.

2. The Order may also be canceled at GLOBALSPORT’s discretion, and GLOBALSPORT reserves the right not to accept Orders if it finds any non-compliance with the personal data provided by the Customer or if these Terms and Conditions are not complied with.

RETURNING THE ORDER

Returns are not accepted.

GUARANTEE

1. The guarantee is provided under the terms and conditions established by the manufacturer of the Products and Services in question, if they are in digital format they will not be guaranteed.

2. Once the warranty period has elapsed, as well as in situations where the warranty is withdrawn due to a cause of exclusion, the costs of any repairs will be borne by the Customer.

3. In order to take advantage of the Products and Services guarantee, the Customer must keep the invoice submitted upon receipt of their Order as proof of purchase.

CUSTOMER OBLIGATIONS

1. The Customer declares that he/she has the necessary legal capacity to accept these Terms and Conditions.

2. The Customer undertakes to:

a) comply with these Terms and Conditions and the applicable legislation;
b) provide accurate, true and current data;
c) not use any identity other than that of the Customer or falsify or conceal their identity in any way;
d) not to carry out illegal activities or activities that violate the rights of GLOBALSPORT or its Customers or other Internet users;
e) not interfere with or condition, in any way, the use of the Online Shop or violate any rules, regulations or standards of the networks connected to the use of the Online Shop;
f) not to introduce, transmit or make accessible in any way material that contains viruses, programs, systems or files that destroy, damage or limit the functionality and/or capacity of any computer, including software and hardware or electronic communications equipment.

SUSPENSION OF THE ONLINE STORE

1. GLOBALSPORT reserves the right to suspend or terminate access to the Online Shop, as well as to request confirmation of any information provided by the Customer.

2. GLOBALSPORT reserves the right to take any action it deems necessary to safeguard its rights in the event of a breach or attempted breach of these Terms and Conditions, and may choose to suspend or block access to and use of the Online Shop, without the Customer being entitled to any compensation or indemnity as a result.

ONLINE STORE MAINTENANCE

1. GLOBALSPORT undertakes to provide access to the Online Shop on a regular and continuous basis, except when this is not possible due to unforeseeable overload of the distribution networks and/or computer systems on which it is based, or due to situations of force majeure (situations of an extraordinary or unforeseeable nature), external to GLOBALSPORT and which cannot be controlled by it), in which case GLOBALSPORT may not be able to guarantee 100% operation 24 hours a day, and undertakes, in the event of an interruption, to regularize the situation as soon as possible.

2. GLOBALSPORT does not guarantee that the Online Shop will operate uninterruptedly or that it will be free of errors, viruses or other harmful elements.

3. GLOBALSPORT undertakes to re-establish access to the Online Shop as soon as technically possible, whenever there are faults for which it is responsible that cause interruptions in the availability of access.

PRIVACY AND PROTECTION OF PERSONAL DATA

1. GLOBALSPORT guarantees, at all times, the confidentiality and protection of all data provided by Clients, particularly personal data.

2. The Customer’s personal data collected at the time of the Order will be processed and stored in computerized form by GLOBALSPORT, in its capacity as data controller, and is intended to be used within the scope of the contractual relationship with the Customer, in accordance with the provisions of the applicable legislation and for the purposes for which it was collected.

3. The Customer is guaranteed, free of charge, the right to access, rectify and update their personal data.

4. The Customer undertakes to respect and comply with all legal regulations regarding the protection of privacy in the electronic communications sector.

RESPONSIBILITY

1. Without prejudice to the provisions of these Terms and Conditions, because the Products and Services made available by GLOBALSPORT through the Online Shop on an open network are subject to interference, interruptions, disconnections or other anomalies, namely as a result of breakdowns, overloads, line loads or other eventualities to which GLOBALSPORT is unrelated, the Customer expressly acknowledges that no liability can be attributed to GLOBALSPORT in relation to potential or actual damages that, directly or indirectly, may result for the Customer as a result of the occurrence of such events.

2. GLOBALSPORT shall not be liable in particular, and except in the case of willful misconduct or gross negligence, for any losses suffered by the Customer arising from:

a) Delays, interruptions, errors and suspensions of communications that originate from factors beyond its control, namely any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, modems, connection software or any computer viruses;

b) Loss of data, as well as the suspension, interruption or any other anomaly of the Online Shop;

c) Accidental or voluntary damage caused to the Customer by third parties or resulting from their use of the Online Shop.

3. GLOBALSPORT has implemented sufficient, necessary and appropriate security measures for the transmission of data over the Internet, however, and since the data circulating on the Internet is not fully protected against possible breaches or deviations, the Customer acknowledges that they are solely responsible for the communication of any username, access code, other confidential codes and all sensitive information.

4. GLOBALSPORT is not responsible for any defects, incorrect operation or incompatibility, namely with the Customer’s hardware, and is not obliged to provide support in the use of the Online Shop, nor guarantee that it ensures the purposes intended by the Customer.

5. All operations carried out in the Online Shop are presumed to have been carried out by the Customer, and GLOBALSPORT is not liable under any circumstances for any abuse or fraudulent use.

6. The Customer is exclusively responsible for the use they make of all the content and functionalities available in the Online Shop and is solely responsible for any direct or indirect damage caused to themselves, to GLOBALSPORT or to any third party in connection with the use they make of the Online Shop, undertaking to pay any compensation that may be awarded as a result of any action, claim or conviction to which it gives rise.

7. The Customer is also responsible for:

a) Acquire and ensure the maintenance of the equipment (hardware) and computer programs (software) required for access to the Online Shop;

b) Pay the costs associated with access to the Online Shop;

c) All the information it makes available on the Internet.

8. The Customer hereby acknowledges that data circulating on the Internet may be protected by copyright or industrial property rights, and therefore assumes full and complete responsibility for the use and storage of information collected on the Internet.

9. GLOBALSPORT does not guarantee that the characteristics of the Product and Service purchased by the Customer through the Online Shop correspond to their expectations.

INTELLECTUAL PROPERTY

Loja Online is a site registered by GLOBALSPORT and the services provided through it are its responsibility. All brands, logos and symbols used in the Online Shop are the property of GLOBALSPORT or it has obtained the appropriate authorization to do so.

APPLICABLE LAW AND JURISDICTION

1. All matters not expressly regulated by GLOBALSPORT in these Terms and Conditions shall be governed by Portuguese law.

2. In the event of a dispute regarding the validity, effectiveness, interpretation, integration, application or fulfillment of these Terms and Conditions, GLOBALSPORT and the Customer agree to submit the dispute to the exclusive jurisdiction of the Porto District Court, expressly waiving any other jurisdiction.
